Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and ERUCK TECHNOLOGIES INC., operating as YongeRide ("YongeRide", "we", "us", or "our"), governing your access to and use of the YongeRide mobile applications, website, and related services (collectively, the "Platform").
By creating an account or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or policies referenced herein. If you do not agree, do not access or use the Platform.
2. The YongeRide Platform
YongeRide provides a technology platform that connects riders seeking transportation with independent driver partners. Please understand that:
- YongeRide is a technology platform, not a transportation carrier. We do not provide transportation services directly. Drivers are independent contractors, not employees of YongeRide.
- YongeRide does not guarantee the availability, quality, or safety of rides, though we make reasonable efforts to ensure a safe and reliable experience for all users.
- Service availability depends on driver availability in your area and may be affected by demand, weather, events, and other factors.
- We offer multiple service tiers with varying vehicle types, capacities, and pricing. Availability of specific options may vary by location and time.
3. Rider Obligations
As a rider, you agree to:
- Provide accurate personal information and maintain the security of your account credentials. You are responsible for all activity under your account.
- Treat drivers with respect and courtesy. Harassment, discrimination, threatening behaviour, or physical violence toward any driver or passenger will result in immediate account suspension.
- Pay all fares and charges incurred through your account, including trip fares, applicable taxes, tolls, surcharges, and any damage or cleaning fees resulting from your use of the vehicle.
- Comply with all applicable laws and regulations, including wearing seatbelts, not bringing prohibited items into vehicles, and following the driver's reasonable instructions.
- Be present and ready at your designated pickup location. Failure to appear may result in a cancellation fee.
4. Driver Partner Obligations
As a driver partner, you agree to:
- Hold a valid Ontario driver's licence (Class G or higher), maintain valid vehicle insurance, and ensure your vehicle meets all City of Toronto vehicle-for-hire requirements.
- Complete the YongeRide verification process, including background checks, vehicle inspection, and any required training or orientation.
- Provide safe, courteous, and professional service to all riders regardless of their origin, destination, race, religion, gender, sexual orientation, or disability.
- Comply with all applicable traffic laws, regulations, and YongeRide's community guidelines and safety policies at all times while using the Platform.
- Maintain your vehicle in safe operating condition and ensure it meets YongeRide's vehicle standards, including cleanliness and mechanical fitness.
5. Fares and Payment
Fares are calculated based on a combination of base fare, distance, time, ride option, and applicable surcharges. You will see an estimated fare before confirming your ride request. The final fare may differ from the estimate based on the actual route taken, traffic conditions, and trip duration.
Payment is processed automatically through your selected payment method on file at the completion of each trip. You agree to maintain a valid payment method associated with your account. Failure to pay may result in account suspension.
YongeRide reserves the right to adjust fares in the event of technical errors, routing issues, or verified rider/driver reports. Any fare disputes must be submitted through the app within 48 hours of the completed trip.
6. Cancellations and No-Shows
The following cancellation policies apply:
- Riders may cancel a ride request at no charge within two minutes of the request being accepted by a driver.
- Cancellations made after two minutes, or after the driver has arrived at the pickup location, may incur a cancellation fee.
- Drivers may cancel a ride if the rider does not appear at the pickup location within five minutes of the driver's arrival, and a no-show fee may be charged to the rider.
- Excessive cancellations by either riders or drivers may result in warnings, temporary restrictions, or account suspension.
7. Safety and Conduct
All users must adhere to YongeRide's Community Guidelines. We have zero tolerance for physical violence, sexual misconduct, threatening behaviour, discrimination, or any illegal activity. Violations will result in immediate and permanent account deactivation and may be reported to law enforcement.
YongeRide provides in-app safety features including trip sharing, real-time GPS tracking, and emergency assistance. While we take reasonable measures to promote safety, we cannot guarantee the conduct of any user and encourage all users to exercise personal safety awareness.
8. Limitation of Liability
To the maximum extent permitted by law, YongeRide shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Platform.
YongeRide's total cumulative liability for any claims arising from or related to these Terms or your use of the Platform shall not exceed the total amount of fees you paid to YongeRide in the twelve (12) months preceding the event giving rise to the claim.
9. Dispute Resolution
Any disputes arising from these Terms or your use of the Platform shall first be subject to informal negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to binding arbitration in accordance with the rules of the ADR Institute of Ontario. The arbitration shall take place in Toronto, Ontario, and be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
10. Modifications to Terms
YongeRide reserves the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification at least thirty (30) days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the modified Terms.
11. Termination
YongeRide may suspend or terminate your account at any time for violation of these Terms, safety concerns, fraudulent activity, or any other reason at our reasonable discretion. You may deactivate your account at any time through the app settings. Upon termination, your right to use the Platform ceases immediately, though certain provisions of these Terms (including limitations of liability, dispute resolution, and indemnification) shall survive.
